Terms of Service

1. Agreement

By using WayScaler ("the Service"), you agree to these terms. WayScaler is a Kubernetes autoscaling operator distributed as a Helm chart that runs entirely inside your infrastructure. We do not host, process, or store your workload data.

2. License

WayScaler grants you a non-exclusive, non-transferable license to install and use the operator on your Kubernetes clusters for the duration of your subscription. The software is provided as-is. You may not reverse-engineer, decompile, or redistribute the operator binary.

3. Subscriptions and Billing

Paid plans are billed monthly per cluster via Stripe. You may cancel at any time; your access continues until the end of the current billing period. No refunds are issued for partial months. Prices are subject to change with 30 days' notice.

4. Beta Program

The beta program provides free access to WayScaler for evaluation purposes. Beta access is limited to 5 managed workloads for 14 days. Beta features may change or be removed without notice. No uptime or performance guarantees apply during the beta period.

5. Support

Starter plans include email support (support@wayscaler.com). Pro plans include priority support with faster response times. Enterprise plans include dedicated support as defined in a separate agreement. Support scope covers installation, configuration, and operational questions about WayScaler. We do not provide support for your underlying Kubernetes infrastructure, cloud provider, or application code.

6. Limitation of Liability

WayScaler is an autoscaling tool that makes scaling decisions on your behalf. While the algorithm is designed for reliability, we are not liable for any costs, outages, data loss, or SLA violations arising from scaling decisions made by the operator. You are responsible for setting appropriate minimum and maximum replica limits and for monitoring your workloads. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

7. Termination

Either party may terminate this agreement at any time. Upon termination, your license to use the operator expires at the end of the current billing period. The operator will continue running in your cluster but will enter a "LicenseDenied" state and stop making scaling decisions.

8. Changes

We may update these terms from time to time. Material changes will be communicated via email to the address on your Stripe account at least 30 days before taking effect.
